1) Purpose & Scope
This Email & Messaging Policy explains how 2740993 ALBERTA INC. (o/a InstaGet) (“we”, “us”, “our”) sends electronic messages and how you can control them. It is designed to comply with Canada's Anti-Spam Legislation (CASL) and align with other frameworks (e.g., CAN-SPAM in the U.S., UK PECR, EU ePrivacy/GDPR). It supplements our Privacy Policy, Cookie / Tracking Notice, and Terms of Service. If there is a conflict, this Policy controls for messaging; otherwise the Privacy Policy applies.
2) Key Definitions
- Electronic Message: Email, SMS/text, instant or direct messages, and in-app messages sent to an “electronic address.”
- Commercial Electronic Message (CEM): A message that encourages participation in commercial activity (e.g., promotions, offers, newsletters).
- Transactional/Service Message: Non-promotional content necessary to operate your account or a transaction (e.g., receipts, security alerts, service outages, material policy updates).
3) What We Send
- Transactional/Service: account verification, password resets, receipts, billing notices, security alerts, critical service or legal notices.
- Commercial (CEM): newsletters, feature announcements, promotions, and offers relating to InstaGet (only with a valid legal basis under CASL or applicable law).
- SMS/IM (if enabled): sent only if you supplied a number/handle and consent where required; you can opt out at any time (see §13, “STOP/HELP”).
4) Consent Under CASL
We send CEMs only with a valid legal basis:
a) Express Consent
- Affirmative action (e.g., unchecked box you choose to tick, double opt-in, clear signup form). No pre-ticked boxes.
- At the point of consent, we identify the sender, our contact details, and the purpose of messages.
- You may withdraw consent any time via the unsubscribe mechanism or by contacting us (processed per §6).
b) Implied Consent (limited duration)
- Existing Business Relationship (EBR): up to 2 years from a purchase/contract; 6 months from an inquiry/quote.
- Conspicuous Publication: your business contact info is publicly posted without a “no CEMs” statement and the message relates to your role/business.
- B2B Context: relevant to your role within an organization with which we have a relationship.
Implied consent expires unless renewed by a fresh qualifying interaction or you provide express consent.
c) Exempt Messages (not CEMs)
- Responses to your request, inquiry, or complaint.
- Messages that deliver a product/service (including warranty, recall, or safety/security information).
- One-time referral messages that identify the referrer with whom we have an existing relationship (see §10).
5) Content Standards (Identification & Accuracy)
- Every CEM identifies 2740993 ALBERTA INC. (o/a InstaGet) and includes valid contact details: mailing address and at least one of email, web form, or phone.
- No false or misleading headers, domains, links, or subject lines. If a provider sends on our behalf, the message states it is “on behalf of InstaGet.”
- “Transactional” messages will not contain promotional content that converts them into CEMs. If marketing content is included, we treat the message as a CEM and require a valid legal basis.
6) Unsubscribe: One-Click, Global, and Timely
- Every CEM includes a free, simple, and effective “unsubscribe” that does not require login or extra steps.
- Unsubscribe is effective for all marketing from InstaGet (you may also choose granular categories in preferences).
- We process unsubscribe requests without delay and in any event within 10 business days.
- The unsubscribe mechanism remains valid for at least 60 days after sending.
7) Frequency & Preference Management
- Frequency cap: Marketing emails limited to no more than one (1) per calendar day per account unless you select a higher-frequency category. Transactional messages are sent as needed.
- Preferences: Manage Cookie Preferences (opens the cookie settings modal; the link also works without JavaScript).
- U.S. sale/share opt-out: For cross-context behavioral advertising and “sale/share” opt-outs, visit Do Not Sell or Share My Personal Information.
8) Tracking Pixels, Link Tracking & Measurement
- Marketing emails may use open-rate pixels and link tracking. Where required, we only do so with consent; otherwise we minimize and aggregate.
- We do not use email-derived identifiers for cross-context behavioral advertising without the required consent, and we honor applicable web choices (e.g., cookie preferences) when you follow links from an email.
- Plain-text or low-tracking versions are available for certain messages where technically feasible.
9) Third-Party Senders & Processors
We may use providers (e.g., email delivery, analytics, CRM, marketing automation) to send messages and manage opt-outs. Providers must apply our suppression lists, honor unsubscribes, and process data only on our instructions.

10) Lists, Referrals & Prohibited Practices
- No purchased/rented/harvested lists. We do not send to addresses obtained without proper consent or lawful basis.
- Referrals: We may send one referral message that identifies the referrer with whom we have an existing relationship; we do not send follow-ups unless you consent. We do not retain the referral recipient’s address beyond sending that one message, except to maintain suppression records.
- No circumvention: No automated/bulk messaging to bypass rate limits, and no attempts to defeat unsubscribe logic or use “no-reply” addresses that reject opt-outs.
11) Records & Retention (Proof of Compliance)
- We maintain consent logs (time/date, source/method, context, IP/User-Agent if available, and preference selections).
- We maintain unsubscribe/suppression lists and apply them across all messaging systems and providers.
- Indicative retention: consent/unsubscribe records ~24-36 months (or longer if legally required); delivery logs per our Privacy Policy.
12) International & Regional Notes
- Canada (CASL): Express or valid implied consent required for CEMs; identification and unsubscribe in each CEM; 10-business-day processing; mechanism valid 60 days.
- U.S. (CAN-SPAM/TCPA): Identification and opt-out for marketing emails; prompt honoring of opt-outs. For SMS, we require prior express consent and comply with STOP/HELP and quiet-hours obligations where applicable.
- EU/UK (PECR/ePrivacy): Opt-in required for direct electronic marketing to individuals unless a “soft opt-in” applies; GDPR duties (lawful basis, transparency, rights) also apply.
13) SMS/IM Rules (If Enabled)
- We send SMS/IM only with the required consent (e.g., prior express consent; for certain U.S. use-cases, prior express written consent).
- Opt-out by replying STOP; get help by replying HELP. We process STOP immediately and confirm by one final message.
- Message & data rates may apply. We honor applicable quiet-hours restrictions in relevant jurisdictions.
14) Security, Authentication & Abuse
- We implement SPF, DKIM, and DMARC for sending domains where feasible, monitor abuse reports, and throttle suspicious activity.
- You must not spoof InstaGet, misuse our domains, or circumvent our unsubscribe mechanisms. We may suspend or block senders/recipients involved in abuse.
15) Children
The Service is for adults 18+. We do not knowingly send marketing messages to minors or knowingly collect their contact details for marketing.
16) Changes to this Policy
We may update this Policy to reflect changes in law, guidance, or practices. Material changes will be posted here and the “Last Updated” date will change.
